Terms and Conditions — Southwest Pools
Services Provided and Client Responsibilities
Southwest Pools agrees to provide comprehensive maintenance, preventative maintenance, repair, and renovation services for the client’s swimming pool. These services may include, but are not limited to:
Recurring cleaning service
Chemical testing, monitoring, and balancing
Equipment inspection
Specialized chemical treatments
Client-approved repairs
Pool renovations, including resurfacing, tile replacement, and equipment upgrades
The specific scope is detailed in the signed maintenance agreement, preventative maintenance agreement, or approved repair/renovation estimate.
Client Responsibilities:
a. Provide clear, unrestricted access to the pool and equipment during scheduled visits.
b. Promptly notify Southwest Pools of any pool or equipment issues.
c. Cooperate reasonably with service-related requests.
d. Maintain proper water levels; if unable, provide a functioning autofill system or hose with water timer. Southwest Pools does not add water or assume responsibility for failed systems provided by the client.
Inclement Weather
Safety is our top priority. During adverse weather conditions (e.g., lightning, heavy rain), full service may not be possible. In such cases, essential chemical balancing will still be addressed when safe. If necessary, specialized chemical treatments may be used to restore pool balance.
Arrival Policy
Residential pools are serviced weekly as part of a route-based schedule. Southwest Pools will do its best to accommodate arrival changes with reasonable notice. Any service requested outside of the routine schedule may incur an additional cleaning fee.
Automatic Renewal Policy
All service agreements renew automatically unless canceled or modified with a 30-day notice before the agreement anniversary date.
Cancellation Policy
Clients may cancel with a 30-day written notice. Prepaid amounts (e.g., annual payments) will be refunded on a prorated basis. Final balances are due immediately, and the payment method on file will be charged.
Payments Accepted
A credit card is required for all recurring services. ACH and e-checks are accepted for invoices, but a card must remain on file for repairs and renovations.
Payment Schedules
Maintenance: Invoices due upon receipt.
Repairs: Due upon completion unless stated otherwise. Projects over $1,000 require a 50% deposit.
Renovations: Follow proposal schedule. If unspecified, full payment is due at signing. Credit card payments incur a 3% processing fee.
Unpaid balances over 30 days are in default.
Delinquent Accounts
Southwest Pools reserves the right to pursue collections on accounts overdue by 30+ days. Interest will accrue at 1.5% monthly (18% annually). Clients are responsible for all legal, administrative, and collection costs. Continued nonpayment beyond 60 days may result in service cancellation.
Disclaimer
Southwest Pools is not liable for damages resulting from:
Natural disasters
Vandalism, fire, or misuse
Use of third-party chemicals
Equipment deterioration from normal wear and exposure
Clients are responsible for proper water levels, trimming vegetation, and maintaining equipment via recommended annual servicing.
Insurance
Southwest Pools maintains standard workers' compensation and general liability coverage. Clients must rely solely on this insurance for claims arising from work performed.
Working Conditions
Clients must inform Southwest Pools in writing about:
Safety systems
Underground utilities
Fragile areas or structures
Clients must ensure safe, accessible work areas and resolve any hazardous conditions before service begins.
Chemical Damage
Chemical treatment near indoor areas or water features can damage floors, walls, and structures. Southwest Pools is not responsible for any resulting damage. To reduce risk, we recommend:
Renovation to control overflow and chemical contact
Monthly chemical checks and preventive maintenance (especially for indoor features)
Even with precautions, some risk remains.
Completion and Acceptance
Clients must inspect completed work within 72 hours. Any concerns must be communicated in writing within that time for resolution. After this window, work is considered accepted.
Jurisdiction
This agreement is governed and enforceable within the State of Florida.
Policy Updates
Southwest Pools reserves the right to amend these terms at any time.
